1. General Use
These Terms and Conditions govern all sales, rentals, and services provided by Touchstone Refrigeration (“Company,” “we,” “us,” or “our”). By engaging our services or renting/purchasing equipment, you (“Customer”) agree to comply with these terms and any additional written agreements or invoices provided at the time of transaction.
2. Services and Equipment
Touchstone Refrigeration provides:

Sales of new and used walk-in coolers, freezers, and related equipment.

Short- and long-term equipment rentals.

Professional installation, removal, and maintenance services.
We reserve the right to modify, discontinue, or refuse service to anyone who violates these Terms or engages in misuse of our equipment.
3. Pricing and Payments
All prices are quoted in U.S. dollars and are subject to change without notice. Payment terms will be outlined on your invoice or rental agreement.

Full payment is due upon completion of installation or before equipment release unless otherwise stated in writing.

Late payments may incur a 3% monthly finance charge or the maximum allowed by Utah law.

Returned checks or failed payments may result in service interruption or repossession of rental equipment.
4. Equipment Rentals
When renting from Touchstone Refrigeration, you agree to:

Use the equipment only for its intended commercial purpose.

Keep equipment in good operating condition and protect it from damage, theft, or misuse.

Not alter, relocate, or sublease the equipment without written consent.

Return all rental units in the same condition as received, ordinary wear and tear excepted.
You are responsible for any loss or damage during the rental period, including costs of repair or replacement. The rental period begins when equipment leaves our facility and ends when it is returned and inspected.
5. Shipping, Delivery, and Installation
Delivery dates are estimates only. We are not liable for delays caused by weather, transportation, supplier issues, or conditions beyond our control.
Customers must provide clear site access, proper electrical connections, and safe working conditions during installation or pickup.
6. Warranties and Disclaimers
Touchstone Refrigeration provides limited warranties as described in your sales or rental agreement. Unless stated otherwise in writing:

All used equipment is sold “as-is.”

We make no implied warranties of merchantability or fitness for a particular purpose.

Our liability for any claim shall not exceed the amount paid for the product or service in question.
We are not responsible for consequential, incidental, or indirect damages (including loss of profits, spoilage, or downtime).
7. Customer Responsibilities
Customers must ensure compliance with all local codes, permits, and regulations when installing or operating refrigeration units.
You agree not to use our website or services for any unlawful purpose, including harassment, infringement, or data misuse.
8. Privacy and Data
We collect only the information necessary to fulfill your orders and improve our services.
9. Indemnification
You agree to indemnify, defend, and hold harmless Touchstone Refrigeration, its employees, and affiliates from any claims, damages, or expenses arising from your misuse of equipment or violation of these Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Utah. Any dispute shall be resolved in the courts of Salt Lake County, Utah.
